Introduction
Della Realty Group Ltd (‘DRGL’) recognises the importance of protecting the privacy and the rights of individuals in relation to their personal information and complies with the New Zealand Privacy Act when dealing with personal information.
Our obligations under the AML/CFT Act
To meet our obligations under the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (AML/CFT Act), we collect personal information about our clients and, in some cases, about related people such as beneficial owners, directors, trustees, and authorised representatives.
We collect this information: directly from you, when you engage us or provide documents during customer due diligence; and indirectly from others, including:
AMLHUB, our AML services provider, who assists us with identity verification, PEP and sanctions screening, and record-keeping;
- public registers (for example, the Companies Office and PPSR);
- identity verification and electronic ID providers;
- credit reporters and other data providers; and
- other professionals involved in your transaction (for example, solicitors, accountants, or other agents).
We collect this information because the AML/CFT Act requires us to do so. If we can't collect it, we may not be able to act on your behalf.

What other personal data do we collect?
DRGL is a boutique real estate agency. Throughout the marketing of properties, we may collect the following information: Name(s), address, email address(s), phone number(s), your comments/feedback for a property and information about you.
How do we use your information?
All data is collected for legitimate business purposes to facilitate sales for our clients. We may contact you for feedback, keep you updated on our services and respond to inquiries.
Who we share your data with
We may disclose your personal information (but only if we need to, for the purpose for which it was collected) to:
- your professional advisers, such as lawyers;
- regulators and government agencies, and anyone else who we are legally required or authorised to share your personal information, such as under AML/CFT Act; or
- our contracted parties for services, ie, photographer(s), virtual tour operator etc.
- any other third parties for the purpose of the business or to comply with any law, rule or regulation with any government authority.
We may also use or disclose information where the use or disclosure is permitted under the Privacy Act, or any other applicable law, such as where the information disclosed is publicly available or where it would not be unfair or unreasonable to do so. We may also disclose information when it is not in a form that identifies individuals.
Under the Privacy Act - clients, staff, or contractors have the right to access and request correction of their personal information. In addition, DRGL is committed to upholding your privacy rights relating to your personal information in relation to any other applicable privacy laws.
How can you review, update, and delete the data we collect from you?
You have the right to request access to the personal information we collect from you, change that information, or delete it in some circumstances. To request a review, please contact DRGL. There may be circumstances where we can not provide you access if it interferes with the privacy of others or if it would result in a breach of confidentiality.
How long do we retain your data?
We keep your personal data for as long as necessary for the purpose set out in this statement, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements).
How we protect your data
DRGL has a secure website, and every measure has been proactively taken to protect any data that may be submitted. However, despite safeguards and all efforts to secure your information, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. We cannot promise or guarantee that hackers, cybercriminals or other unauthorised third parties will not be able to defeat our security and improperly access, collect, steal, or modify the data. We will do our best to implement any necessary precautions to protect your information.
What data breach procedures do we have in place?
We follow the guidelines provided by the Privacy Commission. As our website is linked to the internet and we cannot guarantee that information transmitted will not be intercepted or manipulated, DRGL are vigilant in using systems to reduce the risk of cyber-attacks.
